DMCA Policy
Reporting and resolving copyright infringement on Bailar.
Effective Date: April 6, 2026
Bailar LLC (“Bailar,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the Bailar mobile application and website (collectively, the “Service”) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we will respond to proper notifications of claimed copyright infringement and will take appropriate action, including removing or disabling access to material claimed to be infringing.

2. FILING A DMCA TAKEDOWN NOTICE
If you believe that content on the Service infringes your copyright, you may submit a written notification to our designated agent containing the following information:
(a) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
(b) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
(c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as a URL or screenshot);
(d) Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address;
(e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(f) A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Important: Knowingly submitting a materially false DMCA notice may subject you to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f).
3. COUNTER-NOTIFICATION
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent containing the following:
(a) Your physical or electronic signature;
(b) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
(c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
(d) Your name, address, and telephone number; and
(e) A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the Southern District of Florida) and that you will accept service of process from the person who provided the original notification or an agent of such person.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, we may restore the removed material.
4. REPEAT INFRINGERS
In accordance with the DMCA, Bailar will, in appropriate circumstances, terminate the accounts of users who are repeat infringers. Bailar may also, in its sole discretion, limit access to the Service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
5. MODIFICATIONS
Bailar reserves the right to modify, suspend, or discontinue this DMCA Policy at any time.
