Trademark Use Policy
Permitted and prohibited uses of the 'Bailar' word mark and logo by Studios, instructors, ambassadors, and third parties.
Effective Date: May 24, 2026
This Trademark Use Policy governs the use of the “Bailar” word mark, the Bailar logo, and any associated brand assets (collectively, the “Bailar Marks”) by anyone other than Bailar, Inc. itself. The Bailar Marks belong to Bailar, Inc., a Delaware corporation (successor by statutory conversion effective May 4, 2026 to Bailar LLC, a Florida limited liability company). The Bailar word mark is the subject of pending U.S. Patent and Trademark Office application Serial No. 99741332 (International Class 9), filed April 2, 2026, on an intent-to-use basis under Section 1(b) of the Lanham Act, 15 U.S.C. § 1051(b). Until federal registration issues, we use “™” rather than “®” and ask you to do the same.
This Policy is part of, and is incorporated by reference into, the Terms of Service, the Studio Master Terms, and the Ambassador Agreement.
1. PERMITTED USES (NO PRIOR WRITTEN CONSENT REQUIRED)
1.1 Listings — Studios, instructors, and event hosts with a verified Bailar listing may use the Bailar word mark to describe their listing’s presence on Bailar, e.g. “Listed on Bailar,” “Available on Bailar,” “Find us on Bailar,” “Book through Bailar,” or “Tickets on Bailar.” These uses must be truthful and may not imply Bailar endorsement, partnership, exclusivity, or a special relationship beyond an ordinary listing.
1.2 Linking. You may link to bailar.site and to your own Bailar listing using the Bailar word mark as anchor text, e.g. Book on Bailar.
1.3 Nominative fair use. Journalists, reviewers, academics, students, and competitors may refer to Bailar by name when truthfully describing or commenting on Bailar’s products, services, or company.
1.4 Press and media. Press and media may reproduce the Bailar word mark and logo in articles about Bailar in accordance with ordinary editorial use.
2. PROHIBITED USES (WITHOUT PRIOR WRITTEN CONSENT)
You may not, without Bailar’s prior written consent:
(a) Use a Bailar Mark in your own product name, app name, company name, domain name, social media handle, or trade name, or in any way that suggests your product or service is made, endorsed, sponsored, or affiliated with Bailar;
(b) Modify the Bailar logo, change its colours, recreate it in a different style, animate it, or distort it;
(c) Combine a Bailar Mark with any other word, mark, or device to create a new mark (e.g. “BailarPro,” “Bailar Plus,” “Bailar Studios” as a standalone brand);
(d) Use a Bailar Mark in a way that disparages Bailar, its users, its Studios, or its brand;
(e) Use a Bailar Mark on merchandise (apparel, mugs, stickers, posters) other than merchandise produced by Bailar itself or by a licensed ambassador with written authorization;
(f) Register a domain name that incorporates a Bailar Mark or any confusingly similar variation (including misspellings, transliterations, and hyphenated forms);
(g) Use a Bailar Mark in a way that is misleading, defamatory, infringing, obscene, hateful, or unlawful;
(h) Use a Bailar Mark in connection with content that violates the Bailar Community Guidelines or Child Safety Standards; or
(i) Use the federal-registration symbol “®” in connection with the Bailar word mark while Bailar’s federal trademark application remains pending. Use “™” instead.
3. STYLE GUIDE WHEN YOU DO USE A BAILAR MARK
3.1 Capitalization. Write “Bailar” with a capital “B” and the remaining letters in lowercase. Do not write it in all caps or all lowercase.
3.2 Adjective, not noun. Where reasonable, use “Bailar” as a brand adjective attached to a generic noun (e.g. “the Bailar app,” “a Bailar listing,” “Bailar Pro”), not as a generic verb or generic noun for the underlying activity (do not write “we will bailar this Friday” meaning “we will publish on Bailar”).
3.3 Symbol. Use “Bailar™” at least the first time the word mark appears on a page, marketing piece, or post during the period of pending USPTO registration.
3.4 Logo files. Where Bailar provides official logo files (typically PNG and SVG with light- and dark-background variants), use only those files and respect the clear-space and minimum-size requirements that accompany them. Do not derive a logo file from a screenshot. Brand kits and current logo files are available on request from legal@bailar.site.
4. AMBASSADORS
Ambassadors operating under a signed Ambassador Agreement have an additional, narrow license to use the Bailar Marks for the purposes described in that Agreement (typically, the inclusion of “Ambassador” alongside the Bailar word mark in social-media bios and signature lines). Ambassador use is subject to this Policy in all other respects.
5. NON-INFRINGEMENT REPRESENTATION
You may not use a Bailar Mark in any way that infringes third-party rights or violates applicable law. Bailar does not warrant that your use of a Bailar Mark in your jurisdiction is non-infringing of any third party’s rights, and you remain responsible for your own legal compliance.
6. ENFORCEMENT
Bailar may, in its sole discretion, ask you to stop any use of a Bailar Mark that does not comply with this Policy. Failure to comply with a written request may result in: (a) suspension or termination of your Bailar listing, Studio subscription, or Ambassador Agreement; (b) takedown notices to platforms hosting the offending content (including App Stores, social platforms, and domain registrars); and (c) any remedies available under federal or state trademark law (including 15 U.S.C. § 1114, 15 U.S.C. § 1125, and applicable state-law unfair-competition statutes).
7. QUESTIONS, REQUESTS, AND CHANGES
To request written consent for a use that is not covered by Section 1, to request access to Bailar brand assets, or to report misuse of a Bailar Mark, email legal@bailar.site.
This Policy may be updated from time to time. Material changes will be posted on this page with an updated Effective Date.
